The goal is not to produce a high figure or a low one. It is to produce a figure consistent with the policy and grounded in evidence.

That standard separates a review-ready file from one that falls apart at the first objection.

Legal framework · Colombia

The law places the burden of proof on the policyholder.

Article 1077 of the Colombian Commercial Code requires the policyholder to prove both the occurrence of the loss and its quantum. The insurer, in turn, must prove the facts that exclude its liability.

The claimant proves occurrence and quantum.

The insurer is under no duty to build your claim for you. If entitlement is not established, it may raise objections or decline to pay.

It is not a fixed checklist of documents.

It is a test of evidentiary sufficiency. Each document must bear on occurrence or on quantum; not everything requested is indispensable.

Once entitlement is established, the payment clock starts.

Article 1080 allows one month from the date entitlement is established. For corporate property policies above the statutory threshold, article 185 of Colombia's Financial System Statute (EOSF) permits extension to 60 business days by express agreement.
